Acceptance of Terms

The CNLC is a platform designed to support learning, workforce readiness, and engagement in nuclear. By accessing or using CNLC website, you agree to be bound by these Terms of Use and any applicable additional terms. If you do not agree, you may not use the platform.

For the purposes of these Terms of Use, references to “CNLC” mean the Canadian Nuclear Learning Centre operated by Canadian Nuclear Laboratories (CNL). CNLC is not a separate legal entity, and all rights and obligations arising under these Terms are those of CNL.

CNLC reserves the right to update these Terms of Use at any time. Continued use of the platform following any updates constitutes acceptance of those changes.

Purpose of the Platform

CNLC digital platform is provided to support education, and knowledge sharing across academic, industry, government, and international communities.

You agree to use the platform solely for lawful purposes and in a manner consistent with its intended purpose. Use of the platform for unauthorized, harmful, or disruptive activities is strictly prohibited.

User Conduct

By using CNLC digital platform, you agree that you will:

  • Comply with all applicable laws and regulations
  • Respect the rights and contributions of other users and partners
  • Not attempt to gain unauthorized access to systems or information
  • Not interfere with or disrupt the operation or security of the platform
  • Not use the platform to promote unauthorized commercial or competing services

CNLC may investigate and take appropriate action in response to violations of these obligations.

Intellectual Property

All content available on CNLC digital platform, including but not limited to text, training materials, graphics, designs, and program resources, is owned by or licensed to Canadian Nuclear Laboratories (CNL) or its partners and is protected by applicable intellectual property laws.

You may use such content solely for personal, educational, or internal organizational purposes, provided that:

  • Content is not modified
  • Attribution is maintained where applicable
  • Content is not used for commercial distribution or competitive purposes
  • Any other use requires prior written authorization.

Privacy and Information Use

Use of CNLC digital platform may involve the collection and processing of personal or professional information. Such information will be handled in accordance with applicable privacy laws and CNLC’s Privacy Policy.

By using the platform, you acknowledge that:

  • Information may be transmitted across systems or jurisdictions as part of normal operations
  • No system can guarantee absolute security

You are responsible for ensuring that information you provide is accurate and appropriate for sharing.

CNLC does not control and is not responsible for the content, policies, or practices of third-party sites. Accessing such sites is done at your own risk and subject to their respective terms.

Violation of Terms of Use

CNLC reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate your access to all or any part of the platform, including associated accounts or services, if it determines that you have violated these Terms of Use or any applicable additional terms.
Such actions may be taken to protect the integrity, security, and intended use of the platform and to ensure a safe and productive environment for all users.

No Warranties

The CNLC platform and its contents are provided on an “as is” and “as available” basis.

While reasonable efforts are made to ensure accuracy, reliability, and security, CNLC makes no representations or warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • uninterrupted or error-free operation
  • completeness, accuracy, or timeliness of content
  • fitness for a particular purpose
  • absence of viruses or other harmful components

Your use of the platform and reliance on its content is at your own risk.

To the extent that applicable law does not permit the exclusion of certain warranties, such exclusions shall apply only to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Canadian Nuclear Laboratories, CNLC, and their respective affiliates, officers, directors, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or relating to:

  • your use of or inability to use the platform
  • reliance on any content available through the platform
  • errors, omissions, or inaccuracies in content
  • interruptions or discontinuation of services

This limitation applies regardless of the legal basis of the claim, whether in contract, tort, negligence, or otherwise.

Nothing in these Terms of Use limits or excludes liability where such limitation is prohibited by applicable law, including liability arising from gross negligence or willful misconduct.

Indemnification

You agree to defend, indemnify, and hold harmless Canadian Nuclear Laboratories, CNLC, and their respective affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of or in connection with:

  • your use of the platform
  • your violation of these Terms of Use
  • your infringement of the rights of any third party
  • any negligent or wrongful act or omission by you

This obligation survives termination of your access to the platform.

Availability and Access

CNLC digital platform is intended for use in jurisdictions where its content and services may be lawfully provided.

CNLC reserves the right to limit or restrict access to the platform, or to specific features, at its sole discretion, including based on geographic, legal, or operational considerations.

Users accessing the platform from outside Canada do so at their own initiative and are responsible for compliance with applicable local laws.

Governing Law and Jurisdiction

These Terms of Use and any disputes arising out of or relating to them or the use of CNLC shall be governed by and construed in accordance with the laws of Canada and the laws of the Province of Ontario, without regard to conflict of law principles.

You agree that any legal proceedings shall be brought exclusively in the courts of the Province of Ontario, and you hereby submit to the jurisdiction of those courts.

General Provisions

If any provision of these Terms of Use is found to be invalid or unenforceable, that provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

These Terms of Use constitute the entire agreement between you and CNLC regarding the use of the platform and supersede any prior agreements or understandings.

Failure by CNLC to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other rights.
